Abstract

Este trabajo tiene por objeto el análisis del régimen internacional de las aguas dulces como bien común y como derecho humano, desde una perspectiva del desarrollo sostenible. El análisis separado del régimen internacional de las aguas dulces compartidas y el régimen internacional del derecho humano al agua y al saneamiento nos permite detectar un cambio de paradigma en la regulación de la materia que puede apuntar una progresiva priorización de la garantía del DHAS y la gestión sostenible de las aguas dulces. Sin embargo, el objetivo de conseguir una gestión integrada de las aguas dulces sólo se conseguirá con la introducción del marco del desarrollo sostenible. Éste nos permite integrar, a todos los niveles, las cuestiones medioambientales, sociales, culturales y económicas que afectan a la gestión de las aguas dulces, desde una visión ecosistémica y holística. Además, éste garantiza la unidad de los distintos regímenes internacionales generales concernidos mediante las técnicas, principios y medidas que ofrece el Derecho internacional público.


The present investigation aims to analyze the international regime of the freshwater as a common good and as a human right, from a perspective of sustainable development. Separate analysis of the international regime of the shared freshwater and the international regime of the right to water and sanitation (RTW) allows us to identify a change of the paradigm in the regulation of the matter that can point a progressive prioritization of the RTW protection and the sustainable management of the freshwater. However, the integrated management of the freshwater can only be achieved by the introduction of the sustainable development framework. This permits us to integrate, at all levels, the environmental, social, cultural and economic issues affecting the management of freshwater from an ecosystemic and holistic perspective. In addition, it guarantees the unity of the various international general regimes through techniques, principles and measures that the Public International Law offers.
