Abstract

Enfrentados al quiebre de la premisa que sitúa a la familia como la principal precursora del desarrollo integral de sus miembros y, a falta de una regulación específica, apuntamos a despejar si tiene lugar la reparación de los daños sufridos dentro de la relación familiar. En este contexto, la relación paterno – filial, eje estructurante de la familia, adquiere una especial trascendencia, respecto los daños que en su seno puedan ocasionarse pues, además de constituir el medio natural de vida del niño –en tanto hijo-, se configura como el sustrato base de su identidad personal. El trabajo de investigación se estructura en dos partes: la primera, referida a la familia y la responsabilidad civil, comprende el análisis de la concepción de la familia, su evolución y regulación legal, para luego tratar el conflicto familiar y sus consecuencias jurídicas. A este respecto, se analiza la apertura del derecho de familia a las reglas de la responsabilidad civil, considerando en su aplicación los principios propios del derecho de familia. La segunda parte examina uno de los pilares del derecho de familia, la relación paterno-filial, en perspectiva de los derechos esenciales de los hijos, reconociendo la posible divergencia entre la filiación biológica y la jurídica. Se perfilan los supuesto básicos de la identidad personal, para analizar el derecho a la identidad, dentro del cual la filiación y el derecho a conocer los orígenes, se presentan como componentes centrales. En este segmento se revisan supuestos de daños al derecho a la identidad del hijo en el contexto familiar, tanto en el ámbito de la filiación por naturaleza, como en la adoptiva y, aquella constituida mediante la utilización de técnicas de reproducción humana asistida con intervención de donantes. Finalmente, se reflexiona en torno a la responsabilidad civil y el derecho a la identidad en materia de filiación, proponiendo algunos aportes a incorporar en el ordenamiento jurídico chileno.


Faced with the breakdown of the premise that places the family as the main precursor of the integral development of its members and, in the absence of a specific regulation, we aim to clear if the tort suffered within the family relationship is repaired. In this context, the paternal - filial relationship, structuring axis of the family, acquires a special significance, with respect to the damages that can be caused in its breast, as well as constituting the child 's natural environment of life - as a son or daughter - it is configured as the base substrate of your personal identity. The research work is structured in two parts: the first, referring to the family and civil responsibility, includes the analysis of the family's conception, its evolution and legal regulation, to then deal with the family conflict and its legal consequences. In this regard, the opening of family law to the rules of civil liability is analyzed, considering in its application the principles of family law. The second part examines one of the pillars of family law, the paternal-filial relationship, in perspective of the essential rights of children, recognizing the possible divergence between biological and legal filiation. The basic assumptions of personal identity are outlined, to analyze the right to identity, within which the filiation and the right to know the origins, are presented as central components. In this segment, cases of tort to the right to identity of the child in the family context are reviewed, both in the area of ​​filiation by nature, as well as in the adoptive one, and that constituted through the use of techniques of assisted human reproduction with the intervention of donors. Finally, we reflect on civil responsibility and the right to identity in terms of filiation, proposing some contributions to be incorporated into the chilean legal system.
