Resumen

La tesi efectua una anàlisi històrica exhaustiva de la figura dels secretaris, interventors i tresorers d’administració local, que s’inicia a l’Alta Edat Mitjana fins el règim jurídic actual d’aquests funcionaris. La motivació d’aquest estudi històric és conèixer el moment en el qual apareixen les funcions de secretaria, intervenció i tresoreria (o similars) en els municipis espanyols i catalans, saber perquè van sorgir, quines necessitats pretenien satisfer, quina va ser la seva evolució històrica, quines van ser les conseqüències d’aquesta evolució i per quines raons. Aquest estudi previ és bàsic per entendre l’evolució posterior, i fins i tot per intentar fer noves propostes de futur. Aquesta ha estat una funció pública que s’inicia amb els scribae de les ciutats romanes. A l’edat mitjana eren uns oficis de nomenament real, similar a una habilitació, per assegurar un control sobre aquests “funcionaris”, per la importància de les seves funcions en una època en la que poca gent sabia llegir i escriure i encara menys, entendre les lleis que els afectaven. També per això estaven sotmesos a un fort i sever règim disciplinari. Durant la investigació històrica s’ha constatat, sense perjudici d’altres investigacions, la data d’aparició de la figura de la intervenció de fons municipal, concretada en el “racional”, que es produeix a Barcelona, l’any 1325. Més tard, la corona espanyola va procedir a la patrimonialització dels càrrecs com a font de finançament, fet que va generar importants corrupteles, provocant la resposta de la societat civil a través del Diputat del Comú i de Gremis. La Constitució de Cadis de 1812 marca un punt d’inflexió, de reacció a la situació anterior, preveient que a cada municipi hi haurà un secretari. Però el fet que aquest s’hagués de nomenar pel propi ajuntament, i la manca d’una formació mínima, van provocar un efecte invers al desitjat. No és fins l’Estatut de Calvo Sotelo de 1924 que es regula de forma clara i extensa aquest col·lectiu de funcionaris, apostant decididament per la seva professionalització. A Catalunya, la Mancomunitat, va desenvolupar un paper important a través de l’Escola d’Administració Pública de Catalunya, mitjançant la formació i reestructuració de funcionaris locals. La Llei 7/1985, i la normativa posterior de desenvolupament, marca un canvi important, però que al mateix temps suposa la consolidació de les funcions reservades. Desapareixen els “cossos nacionals” i l’advertiment de legalitat com a eina bàsica de control, però apareixen els Funcionaris d’administració local amb habilitació de caràcter nacional. Es delimiten clarament les funcions reservades, s’estructuren i es classifiquen els llocs de treball, es concreta la forma de selecció i la provisió de llocs de treball, distingint entre el concurs (unitari i ordinari) i la lliure designació. Les modificacions que ha anat experimentat aquesta llei han apostat per l’enfortiment d’aquest col·lectiu professional, especialment pel que fa a les funcions de control. La figura dels FHN té la seva correlació amb els països del nostre entorn, que aposten per atorgar-los funcions directives més clares. A partir de l’anàlisi comparatiu de la regulació d’aquests països, així com de les diferents teories actuals a Espanya sobre la direcció pública local, la tesi conclou amb una proposta, la de l’habilitació local, que intenta conjuminar en aquest col·lectiu professional els coneixements, les tècniques i les habilitats, sobre els que han de recaure les funcions de direcció i gestió, l’exercici de les facultats reglades, i el control de la legalitat dels actes dels ens locals.


The purpose of this thesis is to investigate the moment in which the functions of secretary, intervention and treasury of local administration appear in the Spanish and Catalan municipalities. The thesis also analyses the reason why they appear and the consequences of this evolution. This study is essential to understand the evolution of the administration and to use that understanding to make new proposals to the future. The function of the secretaries has been a public function that initiated with the scribae of the Roman cities. In the Middle Ages, this was a royal nomination profession, to ensure a control on “civil servants”. This was due to the importance of his functions in a period in what few people knew to read and write and even less, understand the laws that affected them. Therefore they were subjected to a severe disciplinary regime. During the historical investigation it has been verified, that the date of appearance of the figure of the intervention of municipal funds (called "the rational") was in 1325 in Barcelona. Later, the Spanish Crown proceeded to the patrimonialization of the charges as a source of funding. That fact generated a significant corruption, causing the response of civil society through the “Diputat de Comú” and “Gremis”. The Cadiz Constitution of 1812 was a turning point, as a reaction to the previous situation, establishing that in each municipality there will be a secretary. However, the fact that the secretary had to be appointed by the city council, and the lack of a minimum training, caused a reverse effect to the desired one. It was not until the Statute of Calvo Sotelo of 1924 that this collective of civil servants was not regulated clearly and extensively. In Catalonia, the “Mancomunitat” developed an important role through the School of Public Administration of Catalonia, by means of the training and restructuring of local officials. The Law 7/1985, and the subsequent development regulations, mark an important change, but at the same time it implies the consolidation of the reserved functions. The "Cos Nacional" and the warning of legality as a basic tool of control disappear, but the Local Administration Officials appear with a national character. The reserved functions were clearly delimited, the jobs were structured and classified, the candidate selection were specified, distinguishing between the contest (unitary and ordinary) and the free designation. The modifications that this law has undergone have opted for the strengthening of this professional group, especially in terms of control functions. The figure of the FHN has his correlation with the countries of our surroundings which are committed to giving them clearer directive functions. From the comparative analysis of the regulation of these countries, as well as of the different current theories in Spain on the local public management, the thesis concludes with a proposal. This proposal is the local qualification, which tries to combine on this professional collective the knowledge, the techniques and the skills. In addition, it addresses to them the functions of directions and management, the exercise of the regulated faculties and the control of the legality of the acts of the local entities.
